General terms & conditions Family ski resort Feuerkogel

1. General
The "Feuerkogel ski region" operates its respective cable cars and lifts as well as pistes at their own liability and on a legally independent basis. Purchasing a ticket for the ski area of the "Feuerkogel ski region" entitles the customer to use the ski areas covered by the "Feuerkogel  ski region". 

By using a valid ticket, a contract of transport and piste use is entered into with the respective lift or piste operator. By using a valid ticket, the customer accepts the terms of carriage, as approved by public authorities, of the lift and piste operator or facilities as posted and submits to the rules of conduct of the International Ski Federation (FIS). 

Breaching the General Terms and Conditions or terms of carriage, as well as repeated failure to follow instructions by the piste/lift organisations, will result in exclusion from any further carriage / piste use and revocation of the ticket without substitution. Furthermore, the customer shall be obligated to pay a processing fee in the amount of EUR 70.00. The same applies in case of malicious damage to the "Feuerkogel " or defamatory and bankruptcy offensive conduct vis-à-vis piste and lift supervising bodies.

2. Tickets
Tickets are not transferable. Subsequent replacements or changes to the validity period of a ticket are not possible. Merely attempting to transfer a ticket without permission is regarded as a breach in terms of point 1. Every ticket holder has to store their ski pass in a way that prevents third parties from gaining access to it. Tickets and credentials for claiming special rates are to be produced to the piste and lift supervising bodies on request.

When purchasing a ticket, € 2.00 per ticket issued will be collected as deposit for the KeyCard. When returning the undamaged ticket to the cash point or the machine provided for this, this amount will be refunded.

Replacement in case of loss, theft or forgotten tickets (data carrier) is excluded. If losing a season ticket, a replacement pass will be issued against production of proof of purchase and ID; the lost card will be blocked. In case of a forgotten season ticket, a day ticket must be purchased at the respective daily rate. The forgotten season ticket will be blocked for this one day.

3. Refunds
Shutdowns of facilities, pistes or entire ski areas required due to weather conditions or other technical reasons, avalanche risk, early departure or disruption do not establish any claims for refunding of fees or extension of the validity period. If carriage is stopped for reasons caused by the passenger, no claim for refunding of fees or compensatory service shall exist. Limited provision of pistes and facilities does not justify any claims.

4. Online shop / vouchers
Only persons aged 18 years old and over are entitled to make purchases in our online shop. The vouchers are either value or non-cash vouchers, depending on the voucher selected. Should the voucher be acquired through an electronic order transaction the relevant conditions will in particular apply (see point 2).

Zum Einkauf in unserem Onlineshop sind nur Personen ab dem vollendeten 18. Lebensjahr berechtigt. Bei den Gutscheinen handelt es sich je nach ausgewähltem Gutschein um Wert- oder Sachgutscheine. Sollte der Gutschein durch einen elektronischen Bestellvorgang erworben werden, gelten insbesondere die diesbezüglichen Bedingungen (siehe Punkt 2).

5. Rescue of injured persons
Insofar as rescue of injured persons is organised by the "Feuerkogel  ski region", the injured customer is to pay a rescue charges contribution. Outside of operating hours, the "Feuerkogel  ski region" cannot carry out the rescue of injured persons.

6. Piste reservations/special tours and special use
In general, pistes may be used in the same manner by all customers. Piste reservations and special tours are possible and allowed only with the express consent by the "Feuerkogel ski region".

For unscheduled deployment of piste/lift supervising bodies or staff or snow groomers caused by the customer, the respectively applicable charge rates will be applied. For all deployments of equipment, a minimum of 20 minutes will be charged.

A fee will be charged for the transport of goods. Liability for transport damage is excluded. Animal transports also require the purchase of a ticket. Animals must be kept accordingly. In the ski and alp area, dogs must be generally kept on a leash, and muzzled during transport and in closed premises of all facilities. 

7. Hours of operation
The ski slopes are - except those with night-time skiing - closed from 4:15 pm to 8.30 pm daily. During this time of closure, no dangers are guarded against and there is a significant risk of injury due to piste grooming, winch ropes, snowmaking and exposed cables and hoses.

8. Protection of the forest
Free accessibility of the forest requires a special sense of responsibility and obliges us to protect it. According to the Forestry Act, going downhill on winter sports gear in the forest and in the area of lifts is permitted only on marked pistes or ski routes. Leaving the groomed and demarcated routes and paths (e.g. also deep powder snow and mogul slopes) as well as using the adjoining forest areas is strictly prohibited and infringement is punishable (Sect. 33 Forestry Act). It is prohibited to enter forest cultures with less than 3 m tree height and to discard garbage and cigarettes. Any non-compliance will be reported and result in revocation of the ski pass entitlement without compensation. 

9. Paragliders
Only pilots with a valid paragliding licence, registered aircraft with third-party liability insurance and a valid ticket are permitted to take off. Take-off and landing are permitted only on the areas marked for this purpose. Landing on all and any ski pistes is strictly prohibited. All statutory requirements for altitude and distance are to be observed. In case of infringement of these provisions, a ban on flying and/or carriage may be issued by the "Feuerkogel  ski region".

10. Liability
Any liability towards customers, be it due to contractual or statutory provisions, for incidents from or during the use of the lift and piste facilities, shall affect only those lift or piste operators in whose ski area such an incident occurs. No liability for other lift or piste operators shall be incurred. 

The liability of the "Feuerkogel ski region" for damage to property and financial losses, occurring in connection with using the lift and piste facilities, shall be excluded in case of slight negligence. The operators of the lift or piste facilities are in no way responsible for items lost by customers in the ski area. Any liability by the lift or piste operators in case of clothing being soiled when using the cable cars and lifts is excluded in any event.

11. It is compulsory to wear a close-fitting mechanical protective device covering the mouth and nose
The stricter interpretation of the terms and conditions applies to this point compared to the conditions of carriage. In the case of people who for health reasons cannot be expected to wear a close-fitting mechanical protective device that covers their mouth and nose, the basic obligation to carry is offset by the actual risk posed by people without mouth and nose protection and the feeling of insecurity of the other passengers. In weighing up the legal interests concerned, the right to physical integrity must be emphasized and passengers who do not wear a close-fitting mechanical protective device covering the mouth and nose are therefore excluded from the transport, even if they present a corresponding medical certificate for exemption can. Only children up to the age of six are excluded from this rule.

12. Paid and promotional activities
All paid and promotional activities on facilities, pistes and ski slopes as well as parking areas (e.g. mounting billboards, panorama cameras and other advertising) of the "Feuerkogel ski region" requires prior written consent. Noncompliance shall result in exclusion from carriage and revocation of the ticket.

13. Data protection provisions 
By purchasing a ticket, the ticket holder agrees to photographic capturing, storage and processing at the point of sale of tickets and points of access for supervisory purposes so as to prevent the improper use of tickets. The customer grants express consent for the data provided by him/her to be forwarded, stored and processed for the purpose of transacting the booking and payment procedure to the database of the "Feuerkogel ski region" and also to be matched with external systems for supervisory purposes. The customer equally agrees to these data being forwarded for the purposes of the statutory provisions and limitations of the Data Privacy Act (DSG) to partners and members of the "Feuerkogel ski region". If the tickets are used as according to contract, the data will be deleted when the period of validity expires. The consent to such data being used can be withdrawn in writing at any time. 

The customer also has the option of submitting the required information via a safeguarded data transfer (SSL). On the part of the companies involved, forwarding – at least of the data necessary for payment transaction – is done by secure data lines at all events.

Your safety is our top priority. For this reason, data such as credit card number, bank code, account number, name and address when paying with credit card are transmitted via certified payment providers via their SSL line, taking PCI guidelines into account.

The customer declares his/her express consent for the forwarding of the payment confirmation to the payment system – following its payment release – for debiting the respective invoice amount due by direct debit authorization with the selected payment method.

13. Choice of law and jurisdiction
These General Terms and Conditions apply insofar as they do not contradict applicable provisions of the Consumer Protection Act of the respective consumer state. Any ineffective provisions, however, shall not become invalid in full, but are to be restricted to the nearest approximating, allowable content. The contractual language is German. 

Austrian law applies (with the exception of reference norms of international civil law and the UN Convention on Contracts for the International Sale of Goods). Competent court with subject matter jurisdiction – provided no legally mandatory jurisdiction exists – is the place of business of Traunsee Touristik GmbH Nfg. Co KG in Ebensee.
